Terms of Service

By accessing, downloading, installing, or using Holingo (the "Service," "Platform," or "Application"), you confirm that you have read, understood, and agree to be legally bound by these Terms of Service ("Terms") and all documents incorporated herein by reference, including our Privacy Policy. These Terms constitute a legally binding agreement between you ("User," "you," or "your") and Holingo ("we," "us," "our," or the "Company"). If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms, and references to "you" include both you individually and that organization. If you do not agree with any part of these Terms, you must immediately cease using the Service. Your continued use of the Service following any updates or changes to these Terms constitutes your acceptance of the revised Terms. We will make reasonable efforts to notify users of material changes via email or in-app notice, but it is your responsibility to review these Terms periodically.

To use Holingo, you must be at least 13 years of age. If you are between 13 and 18 years old (or the age of majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. Holingo is not intended for children under 13, and we do not knowingly collect personal information from children under 13 years of age. If we discover that we have collected information from a child under 13 without verified parental consent, we will promptly delete that information and terminate the account. By using the Service, you represent and warrant that: (a) you meet the minimum age requirement; (b) all registration information you submit is truthful and accurate; (c) you will maintain the accuracy of that information; and (d) your use of the Service does not violate any applicable law or regulation.

To access certain features of the Service — including modules, streaks, leaderboards, friends, and reading plans — you must register for an account by providing your first name, last name, a valid email address, gender, and date of birth. You may also optionally upload a profile photo. You are solely responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to: (a) provide accurate, current, and complete information during registration; (b) update your information as necessary to keep it accurate; (c) notify us immediately at support@holingo.org if you suspect unauthorized access to your account; and (d) ensure that you log out of your account at the end of each session on shared devices. Holingo uses a passwordless authentication system — no passwords are stored. We issue one-time passcodes (OTPs) delivered to your email address to verify your identity at login. You agree not to share OTP codes with anyone. These codes expire within 10 minutes and are valid for a single use only. We reserve the right to disable or terminate any account that we reasonably believe has been accessed without authorization or is being used in violation of these Terms. We are not liable for any loss or damage resulting from unauthorized access to your account where you have failed to maintain the security of your credentials. You may only maintain one account per person. Creating duplicate accounts to circumvent suspensions, bans, or restrictions is a violation of these Terms.

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial educational purposes. This license does not include the right to: (a) sell, resell, or commercially exploit the Service or any portion thereof; (b) reproduce, duplicate, copy, or redistribute any content from the Service for commercial purposes; (c) use any data mining, robots, scrapers, or similar data-gathering or extraction tools; (d) frame or mirror any portion of the Service without our express written consent; (e) reverse engineer, disassemble, decompile, or otherwise attempt to extract the source code of the Service; or (f) access the Service through automated means, including bots, scripts, or crawlers. We reserve all rights not expressly granted in these Terms.

You agree not to engage in any of the following prohibited activities while using the Service: (a) Impersonation: Impersonating any person or entity, falsely claiming affiliation with any person or entity, or misrepresenting your identity in any way. (b) Harassment and Abuse: Harassing, threatening, bullying, intimidating, or abusing any other user, including through the friend-challenge or messaging features. (c) Harmful Content: Uploading, transmitting, or sharing content that is unlawful, defamatory, obscene, hateful, discriminatory, or otherwise objectionable, including content that demeans religious texts, denominations, or faith traditions. (d) Cheating and Manipulation: Manipulating your XP, streak count, quiz scores, or leaderboard position through unauthorized means, including the use of scripts, bots, or third-party tools. (e) System Interference: Attempting to interfere with, disrupt, or disable the Service, its servers, or networks; uploading viruses, malware, or malicious code; or conducting denial-of-service attacks. (f) Unauthorized Access: Attempting to access any part of the Service, accounts of other users, or backend systems without authorization. (g) Data Harvesting: Scraping, collecting, or harvesting any personal data of other users without their express consent. (h) Spam: Sending unsolicited communications, friend requests, or challenge invitations to users who have not consented to receive them. (i) Circumventing Restrictions: Using VPNs, proxies, or other means to circumvent access restrictions, geographic limitations, or account suspensions. (j) Violation of Law: Using the Service for any unlawful purpose or in violation of any applicable local, national, or international law or regulation. Violation of any of these prohibitions may result in immediate account suspension or termination, and may be reported to appropriate law enforcement authorities.

The Service allows you to submit certain content including your display name, profile photo, and other profile information ("User Content"). You retain ownership of your User Content. By submitting User Content to the Service, you grant Holingo a worldwide, royalty-free, non-exclusive, sublicensable license to use, reproduce, display, adapt, and distribute your User Content solely for the purpose of operating, improving, and promoting the Service. You represent and warrant that: (a) you own or have the necessary rights to the User Content you submit; (b) your User Content does not infringe or violate the intellectual property rights, privacy rights, or any other rights of any third party; and (c) your User Content complies with all applicable laws and these Terms. We reserve the right (but not the obligation) to review, monitor, edit, or remove any User Content at our sole discretion without notice if we believe it violates these Terms or is otherwise objectionable. We are not responsible for any User Content submitted by other users. Profile photos: By uploading a profile photo, you represent that you have the right to use and display the image and that it does not contain content that is indecent, offensive, or violates any third party's rights. Profile photos are stored as image files associated with your account.

The Service, including its design, user interface, graphics, logos, trademarks, text, software, and all non-biblical content, is owned by or licensed to Holingo and is protected by copyright, trademark, and other applicable intellectual property laws. The "Holingo" name, logo, and branding are the exclusive property of Holingo. You may not use, copy, reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any Holingo content except: (a) your computer may temporarily store copies of such materials in RAM; (b) you may store files that are automatically cached by your web browser; or (c) for your personal, non-commercial use with proper attribution. Feedback and Suggestions: If you provide us with any feedback, ideas, suggestions, or improvements regarding the Service ("Feedback"), you grant us a perpetual, irrevocable, royalty-free license to use and incorporate that Feedback into the Service or any future product without any obligation to compensate you.

Holingo uses biblical text from the King James Version (KJV) of the Bible, which is in the public domain in most jurisdictions. KJV text is fetched from a public API (raw.githubusercontent.com/wldeh/bible-api) and cached for performance purposes. We also support French and Spanish Bible translations, which are served through our server proxy and may be subject to their respective copyright terms. We make reasonable efforts to use translations that are either in the public domain or appropriately licensed. Holingo makes no claim of ownership over any biblical text. Our use of biblical content is limited to educational display and quiz generation. We do not represent that our Service constitutes authoritative theological commentary or denominational guidance. Users are encouraged to consult recognized spiritual authorities and their own faith communities for theological interpretation. The selection of 73 books reflects the inclusion of the Deuterocanonical books alongside the 66 books of the traditional canon.

Holingo uses artificial intelligence (specifically the DeepSeek AI model) to generate quiz questions, fill-in-the-blank exercises, word scramble prompts, and other learning content based on biblical text. AI-generated questions are cached in our database after initial generation to improve performance and consistency. You acknowledge and agree that: (a) AI-generated content may contain factual inaccuracies, theological misinterpretations, or errors; (b) AI-generated content should not be treated as authoritative biblical scholarship or theological doctrine; (c) Holingo does not guarantee the accuracy, completeness, or appropriateness of any AI-generated content; and (d) we reserve the right to modify, remove, or replace any AI-generated content at any time. When generating quiz content, we transmit the relevant biblical text to DeepSeek's API. We do not transmit your personal information to AI services as part of quiz generation. See our Privacy Policy for more details on AI data processing. The AI content generation is a convenience feature. By using modules, you acknowledge the inherent limitations of AI-generated educational content and agree to exercise your own judgment when engaging with quiz materials.

Holingo features a gamification system including experience points (XP), daily streaks, hearts (lives), streak freezes, trophies, and level progression. These features are provided for motivational and educational purposes only and have no monetary value whatsoever. XP, streaks, hearts, streak freezes, and trophies are non-transferable, have no cash value, and cannot be exchanged for real-world currency, goods, or services. We reserve the right to adjust, reset, modify, or remove any gamification feature, point balance, or achievement at any time and for any reason, including to maintain fair play, correct errors, or update the Service. Streak Freezes: Users may purchase streak freeze protections by spending accumulated XP (200 XP per freeze). Streak freezes protect against losing a daily streak when a day is missed. Streak freezes are automatically applied by the system when a qualifying missed day is detected. We do not guarantee that streak freeze mechanics will function in all edge cases or time-zone conditions. Hearts: Hearts are consumed when quiz questions are answered incorrectly. The heart system is designed for educational engagement and is subject to change. Leaderboard: Your display name, level, and XP total may be visible to other registered users on the public leaderboard. You consent to this display by participating in leaderboard-eligible activities. We are not responsible for any perceived loss of progress, XP, streaks, or achievements resulting from technical issues, account inactivity, policy enforcement, or modifications to the Service.

Holingo includes social features that allow you to add other registered users as friends ("Brethren"), view their progress, and challenge them to XP-based competitions. Friend Requests: You may send friend requests to other users by their registered email address. By adding friends, you consent to having your display name, level, XP, streak, and progress visible to those friends within the friend dashboard and challenge features. Challenges: You may initiate or receive XP-based challenges. Challenges are time-limited competitions. The outcome of challenges is determined by XP earned during the challenge period and is logged in the Service. We reserve the right to void challenges affected by cheating, technical errors, or violations of these Terms. Leaderboard Participation: By using XP-earning features, you opt into the public leaderboard. Your display name and XP ranking are visible to all registered users. If you do not wish to appear on the leaderboard, you should refrain from XP-earning activities or contact us to request exclusion. You agree to use social features respectfully and in accordance with our community standards. We reserve the right to remove social connections or disable social features for accounts that violate these Terms.

Email Communications: By registering an account, you agree to receive transactional emails including: authentication OTP codes, account-related notices (e.g., policy updates, security alerts), and streak reminders. These transactional emails are necessary for the functioning of the Service and cannot be fully opted out of while you maintain an active account. You may optionally enable notification emails for achievements, friend activity, and reading plan reminders via the Settings page. You may unsubscribe from optional emails at any time through Settings or via the unsubscribe link in the email. Push Notifications: You may optionally enable browser or device push notifications to receive reminders about your daily streak, achievements, friend challenges, and reading plan schedules. Push notification subscriptions are stored securely and can be revoked at any time through your browser or device settings or through the Settings page in the app. We use your email address and push notification tokens solely to deliver the communications described above and never for advertising or third-party marketing purposes.

Holingo offers structured Bible reading plans that allow you to track your daily scripture reading over a defined period (e.g., 30, 60, or 90 days). Completing daily reading checkpoints awards XP and contributes to your overall learning progress. Reading plan progress, enrollment dates, and completion statuses are stored in association with your account. We do not guarantee the availability of any specific reading plan and reserve the right to add, modify, or remove reading plans at any time. Reading plans are intended to supplement personal Bible study and should not be treated as a substitute for pastoral guidance, Bible study groups, or theological education.

Holingo includes a spaced repetition system (SRS) designed to reinforce verse memorization by scheduling reviews of previously studied content at algorithmically optimal intervals. Review timing is based on your prior quiz performance and is subject to change as we refine the algorithm. SRS review data, including review schedules, difficulty ratings, and repetition intervals, is stored in your account. This data is used solely to power the review feature and improve your learning outcomes.

The Service integrates with or relies upon the following third-party services: (a) DeepSeek AI — for AI-powered quiz question generation; (b) GitHub CDN (raw.githubusercontent.com) — for KJV Bible text delivery; (c) IP geolocation (ip-api.com) — used at account registration to approximate your country for display purposes; and (d) email delivery service — for sending authentication codes and notification emails. The Service may also contain links to external websites or resources. These links are provided for convenience only. We do not endorse, control, or take responsibility for the content, privacy practices, or terms of any third-party website or service. Your use of third-party services is governed solely by those services' own terms and privacy policies. We are not responsible for any harm or damages arising from your use of third-party services accessed through or in connection with our Service.

We strive to maintain the Service in a reliable and functional state, but we do not guarantee uninterrupted or error-free access. The Service may be temporarily unavailable due to maintenance, upgrades, technical failures, or circumstances beyond our control. We reserve the right, at our sole discretion and without prior notice, to: (a) modify, suspend, or discontinue any feature or the entire Service; (b) impose limits on certain features or restrict access to parts of the Service; (c) change pricing (should we introduce paid features in the future); and (d) update these Terms as described in Section 1. We will make reasonable efforts to notify users of significant Service changes via in-app announcements or email. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the Service.

THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, HOLINGO EXPRESSLY DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO: (A) IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT; (B) WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE; (C) WARRANTIES THAT THE SERVICE WILL MEET YOUR REQUIREMENTS OR ACHIEVE ANY PARTICULAR RESULT; (D) WARRANTIES THAT THE SERVICE WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (E) WARRANTIES REGARDING THE ACCURACY, RELIABILITY, OR COMPLETENESS OF AI-GENERATED CONTENT; AND (F) WARRANTIES THAT DEFECTS OR ERRORS WILL BE CORRECTED. No advice or information obtained from Holingo or through the Service creates any warranty not expressly stated in these Terms. Some jurisdictions do not allow the exclusion of implied warranties, so some of the above exclusions may not apply to you.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL HOLINGO, ITS OFFICERS, DIRECTORS, EMPLOYEES, PARTNERS, AGENTS, SUPPLIERS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO: LOSS OF PROFITS, LOSS OF DATA, LOSS OF GOODWILL, BUSINESS INTERRUPTION, LOSS OF XP OR STREAKS, COST OF SUBSTITUTE SERVICES, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH: (A) YOUR ACCESS TO OR USE OF (OR INABILITY TO ACCESS OR USE) THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE; (C) ANY CONTENT OBTAINED FROM THE SERVICE; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR ACCOUNT OR CONTENT — EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, OUR LIABILITY IS LIMITED TO THE GREATEST EXTENT PERMITTED BY LAW. THE TOTAL AGGREGATE LIABILITY OF HOLINGO FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNT YOU PAID TO HOLINGO IN THE TWELVE MONTHS PRECEDING THE CLAIM (IF ANY); OR (B) ONE HUNDRED DOLLARS (USD $100.00).

You agree to defend, indemnify, and hold harmless Holingo and its officers, directors, employees, partners, agents, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with: (a) your access to or use of the Service; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) your User Content; (e) your infringement of any third-party right, including intellectual property rights, privacy rights, or any other right; or (f) any dispute between you and another user. We reserve the right, at your expense, to assume exclusive defense and control of any matter for which you are required to indemnify us. You agree to cooperate with our defense of these claims.

By You: You may delete your account at any time through the Settings page within the app. Upon deletion, we permanently delete your personal data in accordance with our Privacy Policy. Some residual data (such as anonymized aggregate statistics) may be retained as described in the Privacy Policy. By Us: We reserve the right to suspend, restrict, or terminate your account at any time, with or without notice, for reasons including but not limited to: (a) violation of these Terms; (b) fraudulent, abusive, or harmful conduct; (c) extended inactivity; (d) legal requirements; or (e) discontinuation of the Service. You will not be entitled to any compensation for account termination, including any loss of XP, streaks, or other gamification progress. Effect of Termination: Upon termination, your license to use the Service immediately ceases. Sections of these Terms that by their nature should survive termination shall survive, including Sections 7, 17, 18, 19, 21, and 22.

We encourage you to contact us at support@holingo.org to resolve any disputes informally before initiating formal proceedings. Most concerns can be resolved quickly through direct communication. If we cannot resolve a dispute informally within 30 days, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved by binding arbitration, except where prohibited by law. The arbitration shall be conducted on an individual basis. You waive any right to participate in class-action lawsuits, class-wide arbitration, or any other representative proceeding. Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction for matters involving intellectual property infringement, unauthorized access, or other urgent matters where irreparable harm is alleged. This arbitration clause may not apply to you if you are a resident of a jurisdiction where mandatory arbitration clauses in consumer contracts are not enforceable.

These Terms and any disputes arising hereunder shall be governed by and construed in accordance with applicable law, without regard to its conflict of law principles. To the extent that any claim is not subject to arbitration under Section 21, you agree to submit to the exclusive personal jurisdiction of the courts located in the jurisdiction where Holingo operates its primary business activities. If you are accessing the Service from outside the jurisdiction where Holingo is incorporated, you do so at your own risk and are responsible for compliance with your local laws.

If any provision of these Terms is found to be invalid, illegal, or unenforceable under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, without affecting the remaining provisions, which shall continue in full force and effect. These Terms, together with our Privacy Policy and any other agreements expressly incorporated by reference herein, constitute the entire agreement between you and Holingo with respect to the Service and supersede all prior and contemporaneous agreements, understandings, representations, and warranties, both written and oral, with respect to the Service. Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or our right to enforce it in the future.
